Terms of Service

1. Acceptance of Terms

By accessing or using Senna™, a product of CISO-as-a-Service LLC (CAAS), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use Senna. These terms apply to all visitors, users, and subscribers.

2. Description of Service

Senna is an AI-powered cybersecurity advisory tool built on the OpenAI GPT platform. Senna provides information, guidance, and recommendations related to cybersecurity, compliance, risk management, and information security. Senna is designed to assist organizations in understanding security concepts and best practices.

3. No Professional Advice

The information provided by Senna is for informational and educational purposes only. Senna's output does not constitute legal advice, regulatory compliance advice, licensed security consulting, or any other form of professional advisory service. No use of Senna creates an attorney-client relationship, a fiduciary relationship, or any other professional relationship between you and CAAS.

You should not rely solely on Senna's output for decisions that carry legal, regulatory, financial, or security consequences. Always consult qualified professionals before implementing security programs, responding to incidents, or making compliance determinations.

4. Subscriptions and Billing

Senna is offered on a subscription basis. By subscribing, you agree to the following:

• A one-time setup fee is charged at the time of subscription activation
• Monthly subscription fees are billed automatically on a recurring basis
• All fees are non-refundable except as required by applicable law
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period
• CAAS reserves the right to modify pricing with 30 days written notice to subscribers

5. Platform Requirements

Senna™ is delivered as a custom GPT on OpenAI's ChatGPT platform at chatgpt.com. Access to Senna requires a ChatGPT account, which is free to create. Subscribers acknowledge and agree to the following:

• A free ChatGPT account is required to access Senna. Creating and maintaining a ChatGPT account is the subscriber's responsibility.
• Free ChatGPT accounts are subject to message caps and usage limits imposed by OpenAI. For unlimited, uninterrupted use of Senna, a ChatGPT Plus subscription ($20/month, billed by OpenAI) is strongly recommended.
• The ChatGPT Plus subscription is a separate fee paid directly to OpenAI and is not included in the Senna™ subscription fee.
• CAAS is not affiliated with OpenAI and has no control over OpenAI's platform availability, pricing, or terms of service.
• CAAS is not responsible for service interruptions, feature changes, or access restrictions caused by OpenAI's platform.

6. Access and License

Upon payment of applicable fees, CAAS grants you a limited, non-exclusive, non-transferable license to access and use Senna for your internal business purposes. You may not sublicense, resell, or share your access credentials with third parties. Each subscription is for a single organization.

7. Intellectual Property

Senna™ and all associated content, branding, system prompts, knowledge bases, and methodologies are the intellectual property of CISO-as-a-Service LLC. Senna™ is a trademark of CISO-as-a-Service LLC. You may not copy, reproduce, distribute, or create derivative works from any CAAS intellectual property without express written permission.

8. Acceptable Use

You agree not to use Senna to:

• Engage in any unlawful activity or facilitate criminal conduct
• Attempt to extract, reverse-engineer, or replicate Senna's system prompts or knowledge base
• Resell or redistribute access to Senna without written authorization
• Submit false or misleading information in contact forms or inquiries
• Use Senna in any manner that could damage, disable, or impair the service

9. Limitation of Liability

To the maximum extent permitted by applicable law, CAAS and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Senna, including but not limited to security breaches, compliance failures, data loss, or business interruption, even if CAAS has been advised of the possibility of such damages.

CAAS's total liability to you for any claim arising from these Terms or your use of Senna shall not exceed the total fees paid by you to CAAS in the three months preceding the claim.

10. Disclaimer of Warranties

Senna is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. CAAS does not warrant that Senna will be error-free, uninterrupted, or free of security vulnerabilities.

11. Termination

CAAS reserves the right to suspend or terminate your access to Senna at any time for violation of these Terms, non-payment, or for any other reason with reasonable notice. Upon termination, your license to use Senna immediately ceases.

12. The 10x Employees Commitment

We don't believe in laying people off due to AI acceleration. We believe in 10x'ing your employees to drive more revenue, growth, and marketshare.

Senna™ exists to give every member of your team access to CISO-grade security knowledge, guidance, and decision support that would otherwise require a $400,000+ annual hire. The goal is not to replace your people. The goal is to make them dramatically more capable, more confident, and more valuable to your organization.

Accordingly, CAAS expressly prohibits the use of Senna as a justification for workforce reduction. Any subscriber found to have used Senna, or the cost savings derived from Senna, as a direct basis for laying off, terminating, or reducing the headcount of employees whose roles overlap with Senna's capabilities is in material breach of this Agreement.

Upon discovery of such a breach, CAAS reserves the right to immediately terminate the subscriber's access to Senna without refund, and to pursue all available legal remedies. This provision applies to all subscription tiers, including Senna Core, Senna Executive, and CAAS Private.

This is not a limitation on your right to manage your workforce for legitimate business reasons unrelated to Senna. It is a statement of values. We built Senna to empower people, and we will not allow it to be used as a tool to eliminate them.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which CISO-as-a-Service LLC is registered, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.

14. Changes to Terms

CAAS may update these Terms from time to time. Subscribers will be notified of material changes via email. Continued use of Senna after updated Terms are posted constitutes acceptance of the revised Terms.
